- "Feedback Record"
- a record of work previously undertaken by a Service Provider containing User ratings and comments.

- a Service Provider's business profile containing a description of Services offered and contact information.
- "Service Provider"
- an individual, company or other legal entity providing Services to Users.
- "Service Request"
- a request for Services originating from a User as posted on this Website.
- "Services"
- the service(s) offered or provided by a Service Provider.
- "User"
- an end customer seeking or requesting Services via this Website.
- "Website"
- the website operated by Ahoy There Limited.
Throughout these terms and conditions, the expressions "we", "our" and "us" shall refer to Ahoy There Limited.

- View Service Provider Profiles and Feedback Records to assist you in the selection of suitable Service Providers.
- Post feedback upon our Website on Service Providers upon completion of your Service Requests.
- Our Website is operated by Ahoy There Limited. We provide a facility through which Users can create and advertise their Service Requests and Service Providers can bid to undertake those Service Requests. It is important that you read and understand these terms before using our Website. By accessing or using our Website you agree to be legally bound by these terms, as they may be modified from time to time.
- We reserve the right to change these terms at any time. Amendments will take effect when posted on our Website. However, the terms current as at the start of a particular transaction will apply until that transaction is completed.

- Our Role
Our Website is a venue for Users to seek out Service Providers and vice versa. We do not have and never intend to have any contractual involvement in your transactions. Any disputes between Users and Service Providers are just that - we will not become involved. You must therefore take the utmost care to screen the parties with whom you deal. You will be able to view Service Provider Profiles and Feedback Records to assist you in this regard but we will not screen the parties or Services on your behalf and this is a feature of the relationship between you and us that you willingly accept. - Registration
- You are required to register with us by completing the on-line registration form and submitting it to us. Only adults (i.e. those aged 18 and over) are entitled to enter into legally binding contracts and as a result are the only people entitled to use our service. Any other individuals who are unable to form legally binding contracts are also prohibited from using the service provided by this Website. If you do not qualify, do not use our Website. By registering you are making a statement, upon which we are entitled to rely, that you are aged 18 years or over and capable of forming a legally binding contract.
- On occasions certain registrants will be refused access to this Website. Such suspensions will be within our sole discretion.
- Information You Provide
- Subject to the terms of our privacy policy, you grant us a non-exclusive worldwide perpetual irrevocable royalty free licence to use any information you provide to us or to other users of this Website, including for example the information contained in your Service Requests and feedback submissions.
- Such information should be legal, decent, honest and truthful, shall not infringe any third party's rights, shall not contain any viruses or other malicious computer programming routines and shall not link to any other websites. Without limiting the above, all information you shall provide in connection with yourself, your Service Requests and your feedback ratings will be accurate and genuine.
- Feedback & Comments
- In order for this Website to operate as intended and to aid future Users in the Service Provider selection process, we invite you to post feedback on Service Providers upon completion of any Service Requests which have been facilitated via this Website. Although the posting of feedback is not mandatory, you acknowledge that the value of this Website is dependent on Users sharing their experiences of Service Providers with other Users through the feedback system and we encourage you to do likewise.
- The Feedback Record which is included in the Service Provider Profile is confidential and is shared selectively by the Service Provider with you and with the originators of other Service Requests. You agree to respect the confidentiality of Feedback Records and not to divulge their contents to any third party in any form.
- When posting feedback on Service Providers, you agree only to make honest and justifiable comments and not to make any abusive or defamatory comment. You agree to indemnify us against all and any claims brought against us by any Service Provider in respect of comments you post insofar as the same may not be honest and justifiable.
- Security
You are solely responsible in all respects for all use of and for protecting the confidentiality of any username and password which may be given to or selected by you for use on our Website. You may not share these with or sell or transfer them to any third party. You must immediately notify us of any unauthorised use of them or any other breach of security regarding this Website of which you become aware. - Availability of Site
Whilst we will use all reasonable endeavours to make our service and Website available, we cannot guarantee that they will operate continuously or without interruptions. - Confidentiality
As part of the registration process you create a username and password which must be kept confidential. The purpose of the username is to screen your real identity until such time as you decide to disclose it to a Service Provider. When you post a Service Request on this Website, the only contact details a Service Provider will see are your username and the town/city or county or first half of the post code where the Service Request is to be carried out. No other contact or personal information will be disclosed to the Service Provider unless you have chosen to include this information in your Service Request. We will make available to any Service Provider registered with us the details of your Service Request(s); otherwise, we will not supply any individual details which you provide to us to any third party without first obtaining your consent unless we are required by law or by legal process to do so. - Termination
Ahoy There Limited has in its sole discretion the right to issue a warning, temporary suspension, or an indefinite suspension and termination of your rights to use our service if you:- act inconsistently and in breach of these terms and conditions.
- at any time violate or attempt to violate any rights of any other user of our service or third party.
- are engaged in any fraudulent activity.
- Compliance with Laws
You agree to comply with all applicable laws, statutes and regulations concerning your use of this Website. - General Release
- As previously stated, we act merely as an introductory service providing a forum which allows Users and Service Providers to come together, the former to list the Services they require and the latter to bid for the provision of those Services and for Users then to provide feedback on the Services they have received.
- Therefore we have no control whatsoever over the quality, legality or safety of any Services provided by Service Providers and obviously can accept no responsibility in respect of any of them. Nor can we be responsible for the accuracy of any feedback posted on our Website.
- In recognition of the above, you waive any claim you may have against us that is in any way connected with a dispute you have with a Service Provider and you agree to indemnify us against any losses or liability we suffer as a result of any claim against us by a Service Provider or any other third party as a result of your use of our Website or in relation to your dealings with such Service Provider or third party. This waiver and indemnity shall not apply in the event of any fraud or wilful misconduct by us.
- Your acceptance of these terms and conditions also acts as a general release of Ahoy There Limited and any of its subsidiaries (and all of their officers, directors, agents and employees) from any liability for any claims, loss and damages (both direct and indirect, including loss of profits, goodwill and business opportunity) arising out of or in any way connected with your use of our Website.
- In addition we make no representations or warranties about the accuracy completeness or suitability for any purpose of the information including related graphics published on our Website. From time to time our Website may contain technical inaccuracies or typographical errors. All liability of Ahoy There Limited howsoever arising for any such inaccuracies or errors is expressly excluded to the fullest extent permitted by law.
- Notwithstanding the foregoing, nothing in these terms and conditions is intended to limit any rights you may have as a consumer under applicable local law or other statutory rights that may not be excluded.

Each and every transaction carried out on or facilitated via this Website is deemed to be completed within the United Kingdom and therefore governed by and interpreted in accordance with English Law. The terms of this agreement (and any dispute, controversy, proceedings or claim of whatever nature in relation to them) shall be governed and interpreted in accordance with English Law and the English Courts shall have exclusive jurisdiction in relation thereto. - Events beyond our Control
Ahoy There Limited will not be in breach of this agreement or otherwise liable for any delay in performance if and to the extent that any delay or failure is due to circumstances beyond our reasonable control and including, without limitation, strikes lock outs and other industrial disputes, breakdown of systems or network access, flood, fire, explosion or accident. - Invalidity
If any part of the terms of this charter is unenforceable (including any provision in which we exclude our liability to you) the enforceability of any other part of these conditions will not be affected. - Entire Agreement
This agreement, together with any document expressly referred to within its provisions, contains the entire agreement between us relating to the subject matter covered and supersedes any previous agreements, arrangements, undertaking or proposals, written or oral, between us in relation to such matters or any statements made to you by any person including (without limitation) any of our employees or agents. Save for fraud or fraudulent misrepresentation, we shall have no liability for any such representation being untrue or misleading.
